Terms and Conditions

JHCClivingthedream Ltd- Football Tour Packages

 

1. Introduction

These Terms and Conditions govern all bookings made with JHCClivingthedream Ltd (“we”, “us”, “our”), a UK-based organiser of football tour packages.

All packages offered constitute “package holidays” within the meaning of the Package Travel and Linked Travel Arrangements Regulations 2018 (“PTR 2018”). By booking with us, you agree to be bound by these Terms and Conditions.

 

2. Your Contract with Us

2.1 A legally binding contract is formed when:

  • We receive your completed booking and required deposit; and

  • We issue written confirmation of your booking.

2.2 The person making the booking (“Group Leader”) confirms that:

  • They are authorised to act on behalf of all travellers;

  • All travellers accept these Terms;

  • They are responsible for all payments and communications.

2.3 This contract is governed by English law and subject to the jurisdiction of the courts of England and Wales.

 

 

3. Package Travel Regulations 2018 (PTR 2018)

3.1 Your booking is protected under the PTR 2018. As the “organiser”, we are responsible for the proper performance of all travel services included in your package.

3.2 You will be provided with key rights under PTR 2018, including:

  • Responsibility for performance of all services

  • Protection in the event of insolvency (where applicable—see section 4)

  • Rights to price reductions and/or compensation where services are not performed properly

 

4. Financial Protection (IMPORTANT)

4.1 If your package includes flights, we will provide protection in accordance with the ATOL (Air Travel Organiser’s Licence) scheme where applicable.

4.2 Where ATOL protection applies, you will receive an ATOL Certificate after booking. This confirms:

  • What is financially protected

  • Who is protecting you

  • What to do in case of insolvency

4.3 If ATOL does not apply, we will provide alternative financial protection in line with PTR 2018 requirements.

 

5. Price and Payment

5.1 A non-refundable deposit (as specified at booking) is required to confirm your booking.

5.2 The balance must be paid no later than 10 weeks before departure unless otherwise agreed.

5.3 We reserve the right to cancel your booking if payment deadlines are not met. Cancellation charges (Section 9) will apply.

 

6. Price Changes

6.1 Prices may be varied after booking only in accordance with PTR 2018 due to:

  • Changes in fuel or energy costs

  • Changes in taxes or fees imposed by third parties

  • Exchange rate fluctuations

6.2 You will be notified of any increase at least 20 days before departure.

6.3 If the increase exceeds 8% of the total package price, you may:

  • Accept the change;

  • Accept an alternative package; or

  • Cancel for a full refund.

 

7. Changes by You (Transfer of Booking)

7.1 You may transfer your booking to another person (meeting all travel requirements) by giving at least 7 days’ notice before departure.

7.2 You will be responsible for any costs incurred (e.g. airline amendment fees).

 

8. Changes by Us

8.1 We may make minor changes to your travel arrangements at any time.

8.2 If we are required to make a significant change (as defined under PTR 2018), you will be offered:

  • Acceptance of the change;

  • A suitable alternative (if available); or

  • A full refund.

8.3 Significant changes may include:

  • Change of destination

  • Change of accommodation standard

  • Significant change in travel times

 

9. Cancellation by You

9.1 All cancellations must be made in writing by the Group Leader.

9.2 Cancellation charges are as follows:

  • Deposit: non-refundable

  • 70–30 days before departure: 50%

  • 29–15 days: 75%

  • 14 days or less: 100%

9.3 You may cancel without penalty if we make a significant change and you do not accept it.

 

10. Cancellation by Us

10.1 We may cancel your booking:

  • If minimum group numbers are not met (with reasonable notice);

  • If full payment is not received on time;

  • In unavoidable and extraordinary circumstances.

10.2 In such cases, you will receive:

  • A full refund; or

  • An alternative package (if available).

10.3 No compensation is payable where cancellation is due to unavoidable and extraordinary circumstances.

 

11. Unavoidable and Extraordinary Circumstances (Force Majeure)

11.1 We are not liable for failure to perform our obligations where this is due to events beyond our control, including but not limited to:

  • War, terrorism, civil unrest

  • Natural disasters

  • Epidemics/pandemics

  • Air traffic control restrictions

  • Government action or border closures

 

12. Travel Services and Performance

12.1 We are responsible for the proper performance of all travel services included in your package.

12.2 If any service is not performed in accordance with the contract:

  • You must inform us without undue delay;

  • We will remedy the issue where possible;

  • You may be entitled to an appropriate price reduction or compensation.

 

13. Flights and Carriers

13.1 Flights are subject to the terms and conditions of the operating airline.

13.2 Flight times, routes, and carriers may change.

13.3 We are not liable for airline delays but will assist in accordance with legal obligations.

 

14. Accommodation

14.1 Accommodation will be of the standard described but may vary within local classifications.

14.2 We reserve the right to substitute accommodation of equivalent or higher standard if necessary.

 

15. Behaviour and Conduct

15.1 All travellers must behave responsibly and comply with local laws.

15.2 We reserve the right to terminate a traveller’s participation where behaviour:

  • Poses a risk to others

  • Causes disruption

  • Results in damage

15.3 No refund or compensation will be given in such cases.

 

16. Safeguarding and Supervision (Youth Groups)

16.1 For junior teams and school groups:

  • The Group Leader is responsible for safeguarding and supervision at all times

  • Appropriate adult-to-child ratios must be maintained

16.2 Unless expressly agreed, we do not provide supervision services.

 

17. Insurance

17.1 Adequate travel insurance is mandatory for all travellers.

17.2 Insurance must cover:

  • Medical expenses

  • Cancellation

  • Personal liability

  • Participation in sports activities

 

18. Passports, Visas, and Health

18.1 All travellers are responsible for ensuring they meet entry requirements.

18.2 We accept no liability for refused entry due to failure to comply.

 

19. Limitation of Liability

19.1 Our liability is limited in accordance with PTR 2018 and applicable international conventions.

19.2 We are not liable for:

  • Acts or omissions of third parties unconnected with the package

  • Unavoidable and extraordinary circumstances

  • Issues attributable to the traveller

 

20. Complaints

20.1 Any issues must be reported immediately during the trip.

20.2 If unresolved, complaints must be submitted in writing within 28 days of return.

20.3 Failure to notify us promptly may affect your entitlement to compensation.

 

21. Data Protection

We process personal data in accordance with UK GDPR and applicable data protection laws.

 

22. Entire Agreement

These Terms and Conditions, together with your booking confirmation and any additional information provided, form the entire agreement between you and JHCClivingthedream Ltd.

 

23. Acceptance

By making a booking, you confirm that:

  • You have read and understood these Terms

  • You accept them on behalf of all travellers

  • You have authority to act for your group
